Permanent Release of Liability

Whereas each of the undersigned individuals is desirous of using the facilities and/or equipment of Fort Walton Skating Center, Inc. ("Fort SK8 Family Fun Center") and is doing so entirely upon his or her own initiative, risk and responsibility.

I/We am/ are completely aware of and accept the risk and hazards inherent upon the use of the roller skates and/or equipment and the use of Fort Walton Skating Center, Inc. and its facilities, including the parking lot.

Now therefore in consideration of use of the equipment and/or facilities, whether with or without charge, each of the undersigned individually and/or as a representative of and on behalf of his or her spouse, child or ward, hearby release, discharge and covenant not to sue Fort Walton Skating Center, Inc.

I also understand, and assume the risk, that this is an establishment where people congregate and that social distancing isn’t always possible, and the risk of being infected by a virus, pathogen, or contaminant exists, and I will not hold this establishment, it’s Owners or Employees responsible for such an infection, or associated illness.

Because of risk or maintaining balance on skates and the probability of occasional contact between skaters, accidents can and do happen. We cannot guarantee the skates will not fall apart. You, the customer, have inspected and willingly accepted responsibility for the condition of the rental skates as is. Therefore, you voluntarily assume the risk of any injury when you skate at Fort Walton Skating Center, Inc. This written release is a legally binding contract. I agree that I am skating at my own risk and waive any and all claims for any injury occurring at Fort Walton Skating Center, Inc. including the parking area. I release Fort Walton Skating Center, Inc, the owner, management and employees from all liability and assume full responsibility in the event of any injury, including fatal injury sustained while using, participating and/or observing, whether or not caused by the negligence of Fort Walton Skating Center, Inc.("Fort SK8 Family Fun Center") or its owner, management, employees, or by failure of the equipment.

I HAVE READ THE WAIVER AND RELEASE IN ITS ENTIRETY.

I UNDERSTAND I EXPRESSLY ASSUME ALL RISK INHERENT TO THE USE OF THE FACILITIES AND/OR EQUIPMENT, AS WELL AS PARTICIPATION IN AND OBSERVING ANY ACTIVITY, INCLUDING BUT NOT LIMITED TO THE USE OF THE RINKS, PREMISES AND ANY AND ALL EQUIPMENT.

I FULLY UNDERSTAND IT AND ENTER INTO IT FREELY AND VOLUNTARILY.
